摘 要：目前，在校大学生兼职已然成为一种极为普遍的现象，与此同时兼职过程中各类权益遭受侵害的情况也日益严重。在校大学生在兼职过程中，兼职大学生的健康权、性自主权、隐私权、名誉权等人身权益以及拖欠工资、克扣工资、骗取保证金、押金等财产权益遭受损害最为严重。其主要原因是来自于国家立法的不完善，政府的监督不力，社会各方面的约束，学校管理方面存在缺陷以及大学生自身法律意识的薄弱等等。因此，应当从完善相关国家立法，切实高效执法，加强政府监督，集聚社会各界的关心与帮助，学校做好教育和指导工作以及大学生提高自身能力等方面来维护在校大学生兼职期间的合法权益，以促进在校大学生兼职的健康发展。55811

Abstract：At present, college students' part-time job has become an increasingly common phenomenon，but the kinds of rights during the part-time job infringement situation are increasingly severe. In the process of college students in part-time, such as the right of part-time college students to health, sexual autonomy, privacy, reputation and personal interests and no reason for been deducted or delayed the payments , collected margins, deposit and other property rights that are most easily damaged. The main reasons are from that the national legislations are not perfect, poor regulation of the government, social aspects of constraints, faults of schools’ managements and the weak legal consciousness of college students and so on. Therefore, we should perfect the relevant national legislations, enforce the practical and efficient laws, strengthen the government supervision, gather the attention of the social, schools should do a good job of education and instruction and the students must improve their own abilities to defend the legitimate rights and interests of college students part-time jobs, in order to promote the healthy development of College Students' part-time job.

1 引言
权益是指自然人或者法人“应当享受到的不容侵犯的权利”。而权利是指“规定或隐含在法律规范中，实现于法律关系中的，主体以相对自由的作为或不作为方式获得利益的一种手段。” 笔者认为，“权益是权利与利益的有机结合体，是权利与权利的行使带来的权益之和”。由此可见，在校大学生兼职的权益集合就是指法律、法规给予在校大学生兼职的各类权利以及行使权益而带来的利益的集合，这些也恰恰就是在校大学生在兼职过程中容易被忽略的。
