摘要: 商标产品平行进口法律调控是知识产权和国际贸易的热点和难点问题，在国际上存在较大的争议。本文对平行进口的概念、特点、产生原因进行阐述，在理论研究方面，介绍了传统理论权利穷竭原则和地域性原则，以“米其林轮胎”案件为切入点，对该案件的案情和审理情况做了简要介绍，分析根据两个理论存在的问题，引出我国《商标法》及相关法律法规存在着法律上的空白，商标产品平行进口问题亟需解决，加快平行进口的立法工作是大势所趋。在文章的最后一部分，在充分了解世界主要国家对平行进口的规定和态度的前提下，结合各国对商标平行进口问题的司法实践和发展，对我国解决平行进口法律规制问题提出构想，提出解决商标产品平行进口的新思路。36911

Parallel Imports and Intellectual Property
Protection in International Trade
Abstract: Trademark products parallel imports are always hot and difficult issue in the intellectual property rights and the international trade which arouse big controversy. In this paper, we discuss the concept of parallel imports, characteristics and reasons. In the study of the theory of parallel imports of trademark products, we introduce the traditional theory of exhaustion of rights and territorial approach to resolve the "Michelin" case as the starting point, focusing on the circumstances of the case and a brief introduction which the trial court made. The analysis based on two theoretical problems lead to the gap in China's "trademark Law" and other relevant laws and regulations. We should solve the problem of trademark products parallel imports and accelerate the legislation in parallel imports.At last, in full knowledge of the world's major national regulations and attitudes towards the judicial practice and development of trademark parallel imports, we propose the new idea of legal regulation problems and the solutions to China’s trademark parallel imports.
