摘要:劳务派遣用工存在诸多问题,尤其体现在劳务派遣“三性”原则方面。2014年3月1日施行的《劳务派遣暂行规定》对劳务派遣“三性”原则作出了明确的规定与解释,且确定了辅助性工作岗位的认定标准。然而,新规定并不尽人意,又面临着新的问题与挑战,如临时性工作岗位的期限较短、主营业务和非主营业务很难界定且操作性比较困难以及劳务派遣岗位的合法性等问题亟待解决。因此,文章从现行法律规定出发,对劳务派遣“三性”原则及其法律关系进行概述,解读新规定的具体内涵及其不足。在此基础上,本文对临时性工作岗位的期限、主营业务的经营范围以及劳务派遣岗位的合法性等作出规范性建议,以规范劳务派遣行为,填补现行法律的漏洞,完善“三性”原则的立法规定。54726

Abstract:There are many problems in the labor dispatch,especially in the aspects of the labor dispatch of “the three basic principles”. March 1, 2014 implementation of the "Interim Provisions" of labor dispatch made specific provision and the explanation of the labor dispatch of “the three basic principles”, and to determine the standard of work assistant. However, the new regulations is unsatisfactory, facing the new problem and challenge, such as temporary jobs of short duration, the legitimacy of the main business and non main business is difficult to define and operation more difficult and the legitimacy of the labor dispatch post urgent. Therefore, this article starts from the existing legal provisions to get an overview of the labor dispatch of “the three basic principles” and the legal relationship and to interpret the specific connotation of the new regulations and its shortcomings. On this basis, this paper will make a normative advice on the deadline of the temporary jobs, the main business scope and the standard of work assistant etc to regulate the labor dispatch behavior, fill the loopholes in the existing legal provisions and to improve the legislation of the “three basic principles”.
