摘要:劳动权作为宪法赋予我国公民的基本权利,适用于包括服刑人员在内的我国所有合法公民。劳动报酬权作为劳动者基于履行劳动义务而获得的不受非法限制和剥夺的权利,应当具有同等的适用效力。然而,就目前的司法实践而言,对在监服刑人员的劳动报酬权保障尚不充分,直接影响了其权利义务的实现。本文以此为讨论重点,从宪法、国际人权保护等理论角度,结合当前我国监狱管理实际,详细阐述了保障在押服刑人员劳动报酬权的必要性和现实性。提出在坚持我国特殊国情的前提下,借鉴国内外优秀管理经验,以完善后的《监狱法》为引导,逐步建立对在押服刑人员的劳动报酬的执行、分配机制,并对监狱企业进行法律制度上的指导。旨在创新当前监狱管理模式,实现对在押服刑人员的劳动报酬权保护,达到降低重新犯罪率,构建和谐的社会主义法治中国的目标。53027

Abstract:Labor rights as the basic civil right endowed by the constitution, is applicable to all the citizens in our country include prisoners. Payment for labor rights as workers fulfill labor obligations based on the obtained from unlawful restrictions and deprived of the rights, shall have the same effect applicable. However, on the current judicial practice, protection of labor remuneration right of imprisonment of criminals is not sufficient, a direct impact on the realization of its rights and obligations. For this discussion, from the point of view of the constitution, international human rights protection theory, combined with China's current prison management actual, elaborated security prisoner's necessity and reality of labor remuneration right. Put forward based on the particular situation of our country; learn from the excellent management experience at home and abroad, in order to improve the "Prison Law" as the guide, and gradually establish the prisoner's payment for labor personnel execution, distribution mechanism, and guide the prison company in law. To innovate the prison management, implementation of the prisoner's payment for labor rights protection personnel, to reduce the crime rate, the building of a harmonious socialist rule of law China target.
